BREAKING NOW: Federal Judge Rules 'ENTIRE' Affordable Care Act Unconstitutional

A federal judge in Texas on Friday struck down the Affordable Care Act as unconstitutional, ruling that the law's individual mandate could not be severed from the rest of President Barack Obama's landmark healthcare law.

US District Judge Reed O'Connor sided with a coalition of state governments, led by Texas, that argued removing the "individual mandate" a year ago - a provision included in Trump's tax bill - invalidated the entire law.

White House press secretary Sarah Huckabee Sanders said: "We expect this ruling will be appealed to the Supreme Court".

The GOP-led states who brought the lawsuit asked O'Connor to toss out the entire law after Congress repealed the "individual mandate" penalty for going without coverage.

"Congress stated many times unequivocally - through enacted text signed by the president - that the individual mandate is "essential" to the ACA", O'Connor wrote. The lawsuit argues that, with the enforcement of the insurance requirement gone, there is no longer a tax, so the law is not constitutional anymore.

A spokesperson for California Attorney General Xavier Becerra said defendant states will appeal the decision. Without that penatly, he wrote, "Obamacare" is unconstitutional.

"Today's ruling enjoining Obamacare halts an unconstitutional exertion of federal power over the American health care system while our multistate coalition lawsuit works its way through the courts", Attorney General Paxton said.

"The court ... declares the Individual Mandate UNCONSTITUTIONAL", Reed judgment concludes.

Analysts said the ruling might cause chaos in the final hours of Obamacare enrollment but wouldn't have an immediate effect, since the mandate penalty doesn't shrink to zero until the new year and liberal officials will move for a stay.

"We'll continue to fight in court for New Yorkers and all Americans", she said on Twitter.

In his ruling Friday, O'Connor agreed with Republicans that with the tax aspect of the law scheduled for elimination starting January 2019, the 2012 ruling's defense of the law is invalidated, making the entire law unconstitutional.

Ohio Senator Sherrod Brown tweeted: "This decision threatens the health coverage of 20 million people and undermines pre-existing condition protections for all Americans". They don't need their own health insurance. After Trump ordered the Justice Department to stop defending the health law, a coalition of ACA-supporting states took up the defense. President Trump tweeted. "Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions".

O'Connor's decision could set off a scramble in Congress, where some lawmakers want to step in to defend the decision.

Repealing the Affordable Care Act could lead to about 15 million people losing their health insurance coverage, according to Ana Gupte, a Wall Street analyst at Leerink Partners.

But other states have argued that eliminating Obamacare would harm millions of Americans, and pending any appeal the landmark health care law remains in place.
