Earlier, Prime Minister Malcolm Turnbull tried to quell tension within party ranks by abandoning plans to legislate emissions reduction targets.

Dutton has consistently shied away from admitting his desire to take on Turnbull, with Liberal MP Christopher Pyne telling Sunrise host Kochie just hours before the party room voted, that Dutton remained loyal to the Liberal leader.

This was an inevitable outcome from Dutton and now means he can now lay out his own policy vision and build support for a second push at the leadership.

Since 2007, no Australian leader has succeeded in serving a full three-year term as prime minister.

Mr Dutton faced questions about his eligibility to sit in Federal Parliament last night after reports emerged that he had an interest in two childcare centres in Brisbane through the RHT Family Trust, both of which receive a direct subsidy from the Government.

But the move has failed to silence conservative critics within the Coalition.

"The Labor Party will just want to increase it to 45 per cent - they are in bed with the Greens", she said. Mr Abbott told reporters outside Parliament House on Monday evening.

He argued it should not be enshrined in law as part of the government's new energy policy, known as the National Energy Guarantee (NEG), with consumers facing soaring electricity prices.

"We always thought that he was convicted on climate change issues. And it was a conversion of convenience this morning".
