President Emmerson Mnangagwa's ruling ZANU-PF party said on Friday it was confident that Zimbabwe opposition leader Nelson Chamisa had no case after he challenged presidential election results in court. "All proceedings are suspended pending the determination of the Constitutional Court".

ZEC declared that Mnangagwa won the election with 50.8 percent of the vote while Chamisa was said to have come second with 44.3 percent of the vote.

Advocate Mpofu said the applicant has enough evidence including alleged statistical misrepresentations by the elections administration body, ZEC and other factors that included an uneven playing field. We have a good case and cause!

Zimbabwe's defeated opposition faced a deadline Friday to file its legal challenge to try to overturn the July 30 election result, which has been mired in fraud allegations and a government crackdown on opponents.

The Zimbabwe president Emmerson Mnangagwa has said that his country is open for business, but this new law - the Zimbabwe Democracy and Economic Recovery Amendment Act - could scupper those plans as far as the United States is concerned.

Judges have 14 days to rule on the case, and could declare a victor, call another election, or order a run-off or recount, according to the Veritas legal group. "There is no inauguration that will take place until the matter is determined by the court".

The Brooklyn District Attorney's Office says prosecutors are examining more evidence and may alter the charges. Christina Moses, 21, was also arrested on charges of assault causing physical injury, menacing and harassment.

Former minister of education David Coltart added his voice to confirm the filing of the court papers to challenge the presidential results and some constituencies. "We are seeking a declaration to the effect that the presidential election was not properly conducted", MDC party lawyer Thanbani Mpofu said. Six died after soldiers opened fire on the protesters in a response the opposition alliance called "disproportionate and unjustified".

Diplomats and election observers were present at the hearing in Harare after Biti fled to Zambia but was handed back to Zimbabwean police despite claiming asylum.

"Zimbabwe faces a awful threat from a group of people that has no respect for the law", Biti, who was granted bail Thursday, told the court.

In a joint statement on Thursday, the EU, US, Canadian and Australian missions to Zimbabwe urged authorities to guarantee Biti's safety and human rights.

Mnangagwa wrote on Twitter that Biti was released after he intervened personally in the case. "We call on Zimbabwe's leaders to guarantee Mr. Biti's physical safety and ensure his constitutional and human rights are respected, consistent with the rule of law and Zimbabwe's worldwide obligations and commitments", she said.
