Trump's next Supreme Court justice appointment will cement legacy: Sean Spicer

The Supreme Court has upheld the President's controversial policy

U.S. Supreme Court Justice Anthony Kennedy's retirement, announced on Wednesday, could put some of his signature rulings in jeopardy, including ones that expanded or preserved gay rights and abortion rights. "This is a legacy".

"Remember this, so we have a pick to come up, we have to pick a great one", Trump said. "We have to pick one that's going to be there for 40 years, 45 years".

Undoing or at least putting more limits on that ruling has been a dream of conservative activists and contributed to conservative Christian support for Trump that helped him win the presidency in 2016.

In 2017, Trump nominated and won confirmation of former Tenth Circuit Court of Appeals Judge Neil Gorsuch, a conservative jurist who replaced Scalia and played a key role in several important decisions this term, including those upholding Trump's travel ban on immigrants from several countries, most of which are majority Muslim, on national security grounds, and finding that public employees can not be forced to pay agency dues to unions they do not belong to but bargain collectively on their behalf.

President Donald Trump is deflecting a question on whether he should wait until after the midterm elections to announce a successor to retiring Justice Anthony Kennedy.

The 81-year-old Kennedy said in a statement he was stepping down after more than 30 years. That simple-majority rule remains in place for subsequent nominees.

"Our Republican colleagues in the Senate should follow the rule they set in 2016, not to consider a Supreme Court Justice in an election year", Senator Schumer said, referring to the blocking of President Obama's nominee Merrick Garland by the Republican Senate majority. Republicans are fighting to maintain control of both houses of Congress, with opinion polls showing Democrats have a strong chance of winning back the House of Representatives. "You never had one!" "A high-profile Supreme Court battle will certainly remind all your voters what is at stake".

Wayfair: No big impact from Supreme Court case
A Bicycle Retailer retailer survey earlier this year found that 40 percent of retailers who responded do some online sales. Smaller, local businesses also complained that the previous decisions put them at a disadvantage with online competitors.

Trump's first high court nominee, Neil Gorsuch, was confirmed in April 2017. If so, he or she will provide a fifth vote for the court's conservatives rather than its liberals - and over time reshape the USA legal landscape. Earlier this week, he backed a decision to uphold Mr. Trump's ban on travel by citizens of five Muslim-majority countries.

Without Kennedy, the court will be split between four liberal justices who were appointed by Democratic presidents and four conservatives who were named by Republicans.

Legal experts and lawmakers predict that Kennedy's departure could mean major changes in the nation's legal landscape when it comes to civil rights, environmental enforcement, voting rights, and particularly the protections flowing from Roe v. Wade, the landmark 1973 decision that legalized abortion. Trump's nominee, likely to give the conservatives a solid majority, will face a Senate confirmation process in which Republicans hold the slimmest majority but Democrats can't prevent a vote.

She noted that Trump has previously pledged "to nominate only pro-life judges to the Supreme Court".

Trump appeared to be excited on Wednesday about the new opportunity to reshape the federal judiciary in a conservative direction.

Trump says in the Oval Office that he hasn't "really thought about that". "The White House has to be cognizant of the fact they want to nominate someone who's going to get all 51 Republican votes".
